1. Obligations of the Buyer

1.1 The access to the service offered by the Website is allowed only after the Customer creates an Account: for this purpose, the Customer is asked to provide information that enable his/her identification.

1.2 The Customer is obliged to transmit accurate and complete data about its identity and shall refrain from usurping the identity of others or to give false data.

1.3 If this condition is not met, the Seller ("La Pasta di Aldo") reserves the right to not confirm, suspend or delete the Account.

1.4 In the case of orders placed via store.lapastadialdo.com, the information contained in the General Conditions must be viewed and accepted by the Customer before placing the purchase order.

1.5 The acceptance will be marked in the related space on the website. In the absence of such, the order can not be carried out.

2. Purchase Procedure

2.1 The contract between the Buyer and the Seller ("La Pasta di Aldo") is concluded exclusively in the Internet when the Buyer accesses his account via link to the website store.lapastadialdo.com.

2.2 Inside the e-shop, the Buyer can select and reserve the individual products offered. To do so, simply indicate the product, the quantity and confirm, having chosen any variant. In this way, the selected products will be moved into the virtual shopping cart.

2.3 Until then, all selections can be canceled or confirmed.

2.4 The purchase will be considered completed when the order will be confirmed in the virtual cart and the payment methods will be selected, as described in point 4) below.

3. Shipping methods and delivery time

3.1 All products purchased by the Customer are shipped by "La Pasta di Aldo" with the use of the best national and international couriers.

3.2 Shipments are made from Monday to Friday with the exception of public holidays according to the Italian holiday calendar.

3.3 In order to ensure a shipping service with express courier traced with the best quality/price ratio, our shipping mode is standard: within 72 working hours from the fulfillment of the order at our warehouses, our Shipping Service will email the Buyer a link to access the tracking of the shipment, so that the Buyer can get real-time updates on the delivery.

3.4 Although the forwarder is provided with the telephone number of the Buyer for any appropriate contact, "La Pasta di Aldo" cannot guarantee that the customer will be contacted by telephone, as the shipping service is outsourced, so the phone contact will only be at the discretion of the driver who physically takes care of the delivery.

3.5 Delivery times will be based on the country of delivery: in Italy, the delivery may take place within 72 hours from the shipment of the order; while for EU countries it will take place within 96 hours.

3.6 In the event of problems that lead to longer delivery times, "La Pasta di Aldo" Customer Service will inform the Customer in advance by email or sms/whatsapp message to the number indicated by the Customer.

3.7 "La Pasta di Aldo" Customer Service is always at the Customer's disposal to ensure a safe delivery for every need.

3.8 We only ship to EU countries.

4. Shipments

4.1 The shipping cost on Italian territory is € 5.00 (five euros).

4.2 For shipments abroad, the shipping cost is € 13.00 (thirteen euros).

The Sales Management of "La Pasta di Aldo" reserves the right to apply specific discounts for certain periods of the year or for promotional purposes or depending on special purchasing conditions, and the related conditions will be publicized on the website and applied either on the shipping costs or on the sale prices.

5. Methods of payment and invoicing

5.1 For those who place a direct order, the payment methods will be:

  • Credit Card;

  • Pay Pal.

The delivery of the products will be subject to payment by the Buyer of the related price with the methods provided by "La Pasta di Aldo".

5.2 To receive an invoice, the customer must enter the billing data at the time of purchase; otherwise, it won't be possible to issue invoices after the purchase has been completed.

5.3 Payments made by credit card or by any other electronic means will be processed via a secure connection, supported by Visa, Mastercard and Pay-Pal. The Buyer will pay by credit card, without sharing financial information with "La Pasta di Aldo", which cannot be held responsible for any fraudulent use of the card in question. 6. Returns and Refunds

6.1 Cancellation policy

In accordance with Legislative Decree n. 206/2005 and subsequent amendments, on consumer protection in distance stipulated contracts, "La Pasta di Aldo" informs the Customer that:

a) the Customer may exercise the right of cancellation within 10 (ten) working days from receipt of the ordered goods for any reason, without providing any explanation and without any penalty;

b) only the Customer purchasing the goods for purposes unconnected to his/her business activity may exercise the right of cancellation, providing his/her tax code, and not the VAT number, for the invoicing;

c) the right of cancellation must be exercised by the Customer within the period of time as in point a), by registered letter with return receipt to "La Pasta di Aldo Srl" - via Castelletta n. 41 - 62015 Monte San Giusto (MC) - Italy or by email to the certified e-mail box: lapastadialdo@legalmail.it , within the above-mentioned time limit.

The right of cancellation, pursuant to art. 59 Legislative Decree n. 21/2014, is excluded in the following cases:

  • - Orders of custom-made or clearly customized products;

  • - Orders of products likely to deteriorate or expire rapidly;

  • - Orders of sealed products not suitable to be returned, either for hygienic reasons or for reasons relating to health protection, or products that have been opened after delivery.

6.2 Content of the cancellation statement

The cancellation statement, communicated by the Customer, must necessarily contain:

a) the clear and precise reference to the order the Customer wants to cancel;

b) the express declaration of the Customer’s intention to withdraw the contract wholly;

c) description and code of the products to which the intention of cancellation refers.

6.3 Communication of the cancellation - art. 6.1 lett. a) and c).

Communications of cancellation sent after the expiration of the indicated term will not be considered valid.

6.4 Obligations of the Customer

The Customer undertakes to preserve and protect the products for which he/she intends to exercise the right of cancellation with the utmost diligence and care, by keeping them intact in the original packaging, together with all accessories and related documentation.

6.5 Return of the goods

In order to validly exercise the right of cancellation, the Customer must return the products within the same deadline of 10 (ten) working days from their receipt, to the operational headquarters of the Seller, that is "La Pasta di Aldo Srl" - via Castelletta n. 41 - 62015 Monte San Giusto (MC) - Italy.

The risks and transport costs related to the return of the products to the Seller will be borne by the Customer.

6.6 Refunds

"La Pasta di Aldo" will refund the Customer within 15 (fifteen) days of receipt of the goods returned under the above-mentioned terms and conditions, for the value of the products canceled, including any shipping costs.

6.7 Damage and deterioration

Under no circumstances may the Customer exercise the right of cancellation if the goods are damaged and/or deteriorated.

The return of products that are damaged, not intact, or if there are missing components and/or accessories, including documentation, will not be accepted by the Seller, which will return the goods to the Customer with additional transport costs. In such circumstances, the Customer will not be allowed to exercise the right of cancellation.

6.8 Guarantee, refund or free replacement of products that do not match the requests

For all other cases not covered by the consumer protection right, the non-consumer Customer can exercise the right of cancellation within 5 (five) days from the receipt of the ordered goods, only if the goods received are not compliant with what the Customer ordered. In this case, the goods must be returned within the above-mentioned deadline after notification to the certified email address lapastadialdo@legalmail.it containing the indication of the detected discrepancy. No complaints will be taken into account after 5 days (five days) from receipt of the goods and if the material will not be returned in the original packaging.

Should these requirements fail, the goods will be returned to the sender in "assigned port" terms. However, it is understood that the guarantee on the products can only be the one offered by "La Pasta di Aldo".

According to D.P.R. n. 472 dated 14/08/1996, the returned material must necessarily be accompanied by a transport document containing the number and date of the document relating to the contested product.

7. Communications and complaints

7.1. Written communications to the Seller and any complaints will be considered valid only if sent to the following address: registered mail with return receipt to "La pasta di Aldo" via Castelletta 41 62015 Monte San Giusto, or faxed to +39 0733-539483 or emailed to lapastadialdo@legalmail.it .

7.2 The Customer must also specify, in the account registration form, his/her residence or domicile, phone number or email address where he/she wishes to receive communications from the Seller.

8. Storage conditions

Material inputs and outputs from the warehouse of the "Pasta di Aldo" are managed according to FEFO (First Expired First Out) principle, in order to control and ensure the expiry date and freshness of the products. The warehouse is air conditioned, to ensure proper storage conditions for products. The temperature is controlled according to law or to the manufacturers' indications. Maximum attention is paid to the conservation status of the products both during storage and during shipment.

9. Packaging features

The products are packed and shipped with the utmost care and safety, with respect for the environment and hygiene. In this way, the goods will travel safe and protected.

10. Inspection of the goods

The Customer, or the person in charge of the collection of the goods, is required to check, at the time of delivery and in the presence of the carrier, the integrity of the packages delivered and their number, and to report in writing any discrepancies in the number and/or lack of integrity of the packages in the proper space of the transport document which, duly signed, must be delivered to the carrier. After this, the Customer must contact "La Pasta di Aldo" to report any problems within 5 days of delivery.

11. Liability

11.1 With regard to any damage caused by defects in "La Pasta di Aldo" Products, the provisions of European Directive 85/374/EEC and the Consumer Code will apply.

11.2 "La Pasta di Aldo" assumes no responsibility for disruptions attributable to force majeure or accident, even when dependent on malfunctions of the internet, concerning the shipment and/or delivery, in the event that it fails to execute the order within the time indicated in the contract.

12. Applicable Law and Competent Court

12.1 The sale between the Customer and the Seller is concluded in Italy and these General Conditions are governed by Italian Law, with the express exclusion of the 1980 Vienna Convention on Contracts for the International Sale of Goods ("CISG").

12.2 The norms provided by the Consumer Code and/or other consumer protection laws shall not apply in the event that the Customer has a professional status, pursuant to art. 3, 1, paragraph, lett. c), of the Consumer Code.

12.3 For the settlement of disputes relating to the interpretation, execution or resolution of these General Conditions or of individual purchase orders, in the event that the Customer has the status of Consumer pursuant to art. 3, paragraph 1, lett. a), of the Consumer Code, the Court of his/her City of residence or domicile has exclusive jurisdiction. In all other cases, the territorial jurisdiction is exclusively the one of the Court of Macerata, thus excluding any other jurisdiction.

13. Acceptance of Contract conditions

13.1 By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Terms and Conditions of the Contract.

13.2 Under the terms and for the effects referred to in art. 1341 and 1342 CC, the Customer, after carefully reading and understanding them, expressly approves and accepts the following clauses:
